Law Forward Victory Guarantees Wisconsinites Can Return Absentee Ballots to Polling Locations on Election Day

Motion to Dismiss granted in Luedtke vs. Yunker will make it easier for voters to return absentee ballots and uniformly enforce the existing Wisconsin Election Commission policy

BROOKFIELD, Wis. – Law Forward announced a major victory in Luedtke vs. Yunker, which ensures voters can return absentee ballots to their polling locations on Election Day.

The case was originally filed by the City Attorney of Brookfield and sought to appeal a Wisconsin Election Commission (WEC) decision finding that Law Forward’s client, Andrew Yunker, should have been allowed to return his absentee ballot to his polling location. The rejection of Yunker’s ballot, along with his wife’s, violated WEC guidelines.

“Absentee voting is safe, secure, and convenient. But all too often the process can seem confusing,” said Law Forward attorney Scott Thompson. “Now we have clarity: Wisconsinites can return their absentee ballots to their polling locations on Election Day.”

Law Forward’s motion to dismiss was granted by Waukesha County Circuit Court Judge Paul Bugenhagen Jr. on Friday, ending the appeal of the underlying WEC decision. Yunker’s original complaint to WEC is available here and the judge’s order dismissing the case is available here.
