Suspect criminally charged in connection to the accidental shooting of his 2-year-old child
On Wednesday, September 23, 2020, the Milwaukee County District Attorney’s Office issued a criminal charge against Tommy Smith III., in connection to the accidental shooting of his 2-year-old child that occurred on Saturday, September 19, 2020, on the 2100 block of North 38th Street.
The child, while unrestrained in the vehicle with the suspect, obtained and discharged a firearm subsequently striking himself in the head. The child sustained serious injuries and was transported to a local hospital for treatment where he remains in critical condition.
Smith III was charged with one count of Neglecting a Child – Consequence is Great Bodily Harm. If convicted, he could face up to 12 years and 6 months in prison and he may be fined up to $25,000, or both.
The Milwaukee Police Department would remind the public to secure and keep firearms out of the reach of children.
