WisDems First Vice-Chair Sarah Godlewski on State Supreme Court Invalidating 1849 Abortion Ban

The state’s liberal majority on the state supreme court has ruled the pre-Civil War law as invalid

MADISON, Wis. — In response to the Wisconsin State Supreme Court ruling, in a 4-3 decision, to invalidate the 1849 Abortion law, the Democratic Party of Wisconsin’s first Vice-chair Sarah Godlewski released the following statement

“Today is a victory for personal freedoms and reproductive health — and a defeat for Conservative Justice Rebecca Bradley and Republicans in the legislature who previously voted to uphold this archaic law that banned abortion in nearly every case. This decision is further proof that elections matter — Wisconsinites have continuously gone to the polls and voted to protect their personal rights that have been under attack here in Wisconsin and nationally. Our work is not done, and we know efforts to curtail the freedoms we have fought so hard for will not stop; but neither will we as we continue to fight every day to elect those who respect the right to make our own choices, not try to take them away.”

The newly liberal court invalidated the ruling, while the conservatives voted to keep it the law. Conservative Justice Rebecca Bradley, who is up for re-election in April 2026 and previously compared abortion to holocaust and slavery, spoke out against the decision, saying that the liberal majority “erases a law it does not like.”
