Coalition Responds to Court Ruling on Port Washington Ballot Initiative

The Metropolitan Milwaukee Association of Commerce (MMAC) and a coalition of regional business, real estate and construction partners are disappointed by Monday’s decision denying a request for a preliminary injunction related to the proposed Port Washington referendum on tax incremental financing districts.

Bottom line: If this ordinance passes, it compromises the economic health of Port Washington and sets a dangerous precedent for communities statewide.

While we respect the judicial process, this ruling does not change the serious legal concerns surrounding the proposed ordinance – as acknowledged by the court. Those concerns may be addressed if the measure passes the electorate. In that case, the coalition is prepared to continue litigation challenging an ordinance that violates state law and undermines long-established economic development processes.

State statute already provides a clear, transparent framework for the creation and oversight of tax incremental districts, including public notice, hearings and approval by a joint review board that includes citizen participation.

The impacts of this ballot initiative’s passing are not theoretical. Injecting additional political hurdles through referenda introduces uncertainty, delays and risk that will make communities adopting measures like this less competitive for job-creating investment.

The coalition is also deeply concerned by the role of outside advocacy groups influencing and disrupting lawful, locally governed economic development decisions. Their presence in this process could result in deterring investment, limiting job creation and preventing long-term tax base expansion – outcomes that will harm the 13,000 residents of Port Washington and potentially others throughout the region and state.

The coalition’s goal has never been to prevent public participation or dialogue. Rather, it is to ensure economic development decisions remain in sync with state law and that communities retain the ability to compete in an increasingly competitive national landscape.
