Many Electronic Vaping Devices Must Be Off Shelves Before September 1

Starting September 1, an electronic vaping device that is not listed on the Department of Revenue’s Electronic Vaping Device Directory is illegal to offer for sale in Wisconsin. Currently, there are 216 vaping device products listed on the directory. Electronic vaping devices that contain hemp and do not contain nicotine are not required to be on the directory until July 1, 2026.

A retailer or manufacturer that sells or offers for sale an electronic vaping device that is not listed on the Wisconsin Department of Revenue‘s electronic vaping device directory will be subject to a forfeiture of $1,000 per day for each device. These devices are also subject to seizure.

The Department of Revenue is required to maintain a publicly available directory of electronic vaping devices under sec. 995.15, Wis Stats.
