Senator Devin LeMahieu
Wisconsin State Capitol
2 E Main St, Room 211 South
Madison, WI 53703

Majority Leader LeMahieu,

On December 14, 2020, Wisconsin Elections Commissioner Robert Spindell participated in a meeting at the State Capitol as one of 10 Republicans who claimed to be Wisconsin’s official Presidential Electors. These electors met on the same day Wisconsin’s actual electors met to certify Joe Biden and Kamala Harris as the next President and Vice President, respectively, having prevailed by 20,682 votes in our state.

These 10 Republicans, Mr. Spindell included, then submitted forged documents to the United States Congress which claimed that Donald Trump had won the 2020 election and that Wisconsin was casting its 10 Electoral Votes on his behalf. This despite all available legal options having already been exhausted, including recounts and multiple court challenges.

The actions of these 10 individuals went against the founding principles of our representative democracy, namely the lawful and peaceful transition of power. There is a strong argument to be made that they committed various state and federal crimes. Two of the fraudulent electors, Andrew Hitt and Kelly Ruh, were recently subpoenaed by the January 6th Committee of the United States Congress, where they will appear later this month to testify on their involvement. The United States Department of Justice also announced they were also looking into the fraudulent electors in Wisconsin and 6 other states for possible charges.

Despite Mr. Spindell’s clear involvement in the fraudulent elector scheme, which multiple news outlets have reported was part of a coordinated effort to overturn the 2020 Presidential Election in favor of former President Trump, you saw fit to re-appoint Mr. Spindell to serve on the Wisconsin Elections Commission (WEC) for a five-year term ending in 2026.

Today, I am calling on you to stand up for the integrity of our free and fair elections by rescinding your appointment of Mr. Spindell as WEC Commissioner, replacing him with someone who respects and adheres to the democratic process. Failing to do so would be an admission that you support Mr. Spindell’s actions, and would serve as a strong signal to those who would attempt to defraud future Wisconsin elections that so long as your preferred candidate is the beneficiary, you will do nothing to prevent or intervene to stop future crimes against America.

I look forward to your response. Wisconsin is counting on you.

Thank you, Senator Larson, for keeping this issue in front of the public. Spindell’s participation in a fraudulent elector scheme to thwart Wisconsin’s true election results is on its face clear cause for him to be banned from, much less reappointed to, a position on the Wisconsin Elections Commission. Republican legislators in Wisconsin need to get a collective spine and stand up for honesty, truth, and free and fair elections. These are essential ingredients for American democracy’s survival.
