Mequon – Today, in a significant victory for First Amendment rights, an Ozaukee County Circuit Court Judge dismissed the charges against Paul Buzzell, a Mequon-Thiensville School Board member, who was previously charged with voter fraud for posting a photo of his completed ballot on Facebook.
[inaqrticlead]Attorneys Michael Chernin and Michael Maistelman, representing Mr. Buzzell, successfully argued that the charges against their client were in violation of his First Amendment rights. The dismissal of this case sets a precedent affirming the importance of free speech in the context of political expression.
“This case was about more than just a Facebook post; it was about protecting the fundamental right to freedom of expression,” said Attorney Michael Chernin. “We are pleased with the court’s decision to uphold these essential liberties.”
Attorney Michael Maistelman added, “The dismissal of this case is a reminder that the laws need to evolve with the changing ways in which we communicate and participate in our democracy.”
Mr. Buzzell faced charges including a maximum of 3 ½ years imprisonment and fines up to $10,000 upon conviction. The case had garnered significant attention, highlighting the tension between electoral laws and constitutional rights in the digital age.
“We hope this decision encourages a thoughtful discussion on how our electoral laws intersect with the rights guaranteed by the Constitution,” concluded Chernin.
