Response to Federal Gender Policy Proposal
A Statement by The City of Milwaukee Equal Rights Commission - Tuesday, October 23, 2018
The New York Times revealed Sunday that the Trump administration plans to legally redefine sex and gender. This plan would effectively exclude transgender and non-binary students from legal protections under Title IX, paving the way for the further erosion of basic civil rights for transgender, intersex, and gender nonconforming people to strict, obsolete gender roles.
Under the Obama administration, federal agencies recognized gender identity as a protected class and considered complaints brought by transgender and non-binary students. At the same time, a growing number of federal courts have also recognized their status.
This is a deliberate attempt to roll back their civil rights and legislate a class of people out of legal existence. If enacted, it would be catastrophic to transgender and non-binary students. The federal government, speaking with its incredibly powerful voice, would effectively render these students as people without protection.
This action defies the principles of human decency and civil rights. The City of Milwaukee Equal Rights Commission implores all people of conscience to speak with a united and even more powerful voice to stop these draconian and hurtful proposals.
