Rep. Fitzgerald Urges Action on NDO Reform After DOJ Report Finds Abuses
WASHINGTON, DC – Congressman Scott Fitzgerald (WI-05) released the following statement in response to the release of the Department of Justice, Office of Inspector General (OIG) report on the use of non-disclosure orders (NDOs) against Members of Congress, congressional staff, and members of the news media:
“The report released by Inspector General Horowitz shows an abdication of the compulsory process by the Department of Justice to seek communications records and impose non-disclosure orders (NDOs) on Congress and the press. The findings by the OIG not only expose a glaring violation of constitutional rights and a disruption of Congress’ oversight responsibility, but also reinforces the need to reform the Department’s use of NDOs. I call on Senate Majority Leader, Chuck Schumer, to immediately consider my NDO Fairness Act, which passed the House with overwhelming bipartisan support. This commonsense bill would reign in the prosecutorial abuse and executive branch overreach exposed by the OIG report by imposing proper guardrails on the Department’s use of NDOs. Now is the time to pass this important legislation.”The multi-year investigation by the OIG found the Department of Justice sought and obtained non-content communications records of two Members of Congress, 43 Congressional staff, and multiple members of news media while imposing NDOs to prevent third-party communications providers from notifying Congress and the news media of the search.
