Fitzgerald Responds to Supreme Court Decision to Overturn Chevron
WASHINGTON, DC – Congressman Scott Fitzgerald (WI-05) issued the following statement after the Supreme Court of the United States (SCOTUS) ruled 6-3 to overturn a 1984 decision in Chevron v. Natural Resources Defense Council that gave bureaucrats power in determining courts, when interpreting an ambiguous statute, should defer to the agency’s interpretation of the statute.
“Since the Supreme Court first established Chevron deference in 1984, the executive branch has circumvented Congress to issue regulations with the force of law,” said Rep. Fitzgerald. “This has added billions in regulatory costs and allowed unelected bureaucrats at agencies like the ATF and FTC to issue sweeping rules that harm Americans, with no guardrails. I’m pleased that the Court has chosen to give the legislative power back to Congress and repeal Chevron, ensuring that courts independently consider what Congress has said through its statutes rather than putting a thumb on the scale in favor of federal agencies.”
