Congressman Fitzgerald Votes to Protect American Communities and Preserve Life During First Week of Trump Administration

WASHINGTON, DC – This week, Congressman Scott Fitzgerald (WI-05) voted in favor of two bills that keep our communities safe and preserve life: S. 5, the Laken Riley Act, and H.R. 21, the Born-Alive Abortion Survivors Protection Act. Congressman Fitzgerald issued the following statement:

“This week, Republicans delivered on our promise to the American people to keep our communities safe by passing the Laken Riley Act. Laken Riley would still be alive if not for the open-border policies of the Biden-Harris Administration that allowed criminal illegal aliens to roam free. This commonsense bill ensures detention of illegal aliens who commit serious crimes, and I was proud to support real reform that will finally be signed into law,” said Congressman Fitzgerald.

“I was also proud to support the Born-Alive Abortion Survivors Protection Act. There is nothing more fundamental than the right to life. A baby that survives an abortion and is born alive into this world should be treated with the same care and dignity afforded any human life. America must get back on track and protect the most innocent among us.”

Background:

The Laken Riley Act requires detention of illegal aliens who commit theft, assault of a law enforcement officer, or any crime that results in death or serious bodily injury to another person, and allows a state to sue the Federal government on behalf of their citizens for not enforcing the border laws, particularly in the case of parole. This bill passed the House on January 22, 2024, by a vote of 263-156 and will now go to President Trump’s desk to be signed into law.

The legislation is named for Laken Riley, the 22-year-old nursing student who was murdered by an illegal alien on the University of Georgia’s campus on February 22, 2024. Her murderer, Jose Ibarra, is an illegal alien who had been previously cited for shoplifting by the Athens Police Department. Ibarra was found guilty in November 2024 and has been sentenced to life without parole.

Born-Alive Abortion Survivors Protection Act requires health care practitioners who are present at a live birth following an abortion or attempted abortion to provide the necessary skill and care to preserve the life and health of the child. After those efforts, the health care worker must immediately transport and admit the child to a hospital. Failure to provide this standard of care could result in criminal penalties for an offending health care provider, including fines and up to five years in prison. This legislation also authorizes mothers of abortion survivors to bring a civil cause of action against a health care provider who violates this standard. This bill passed the House on January 23, 2024, by a vote of 217-204.
