First Hearing in Taxi Owners’ Lawsuit to Maintain Monopoly on Milwaukee’s Taxicabs
Tomorrow, a group of Milwaukee taxi companies will have their first day in court to ask Judge Lynn Adelman of the U.S. District Court for the Eastern District of Wisconsin to issue a preliminary injunction against the recently-passed ordinance lifting the cap on the number of taxis allowed to operate in the city.

The owner’s lawsuit, which was filed August 25th, 2014, follows a decision in state court last year declaring the city’s law imposing a cap on the number of taxicabs unconstitutional.
“The cab companies’ lawsuit is a last-ditch attempt to preserve their unconstitutional monopoly on Milwaukee’s taxicab industry,” said Institute for Justice (IJ) Attorney Anthony Sanders. “Milwaukee’s taxi drivers and riders deserve a free market that allows everyone to participate on equal footing.”
On August 29th, just four days after the cab companies filed their lawsuit, IJ moved to intervene in the lawsuit to ensure that taxi drivers’ voices are heard as the suit moves forward. The Institute represents drivers Jatinder Cheema and Saad Malik in the intervention in federal court. Cheema was a plaintiff in the previous lawsuit that struck down the unconstitutional cap in 2013. They are intervening in the case and will file a motion to have the case dismissed, upholding the new law that has made Milwaukee one of the freest transportation markets in the nation.
