AG Kaul Wins Summary Judgment Against Trump Administration Attempt to Block Ev Infrastructure Funding
MADISON, Wis. – Attorney General Josh Kaul and a multistate coalition have secured a win blocking the Trump administration’s attempt to illegally withhold billions of dollars in congressionally approved funding for the National Electric Vehicle Infrastructure (NEVI) Formula Program.
In the coalition’s multistate lawsuit, the court granted summary judgment last week concluding that the Trump administration had violated the Administrative Procedure Act and that its actions were arbitrary and capricious. The judgment protects NEVI funding and prevents the U.S. Department of Transportation from taking similar action in the future.
“This ruling safeguards tens of millions of dollars for projects in Wisconsin against the Trump administration’s unlawful attack on this program,” said AG Kaul. “This outcome is good for jobs and clean air in Wisconsin.”
In Wisconsin, the attempted funding freeze threatened more than $62 million in NEVI funds and the jobs and economic activity tied to EV charging station projects in the state.
Joining AG Kaul in bringing the lawsuit were the attorneys general of Arizona, California, Colorado, Delaware, Hawai‘i, Illinois, Maryland, Minnesota, New Jersey, New Mexico, New York, Oregon, Rhode Island, Vermont, and Washington.
