Promises Kept: Wisconsin Withdraws from GOP Lawsuit Attacking ACA

"It’s time for Republicans to stop blocking the will of the people and work with us to expand healthcare."

MADISON – The United States Court of Appeals for the Fifth Circuit today granted Wisconsin’s motion for dismissal from Texas v. United States, the Republican lawsuit that seeks to gut the Affordable Care Act.

Gov. Tony Evers and Attorney General Josh Kaul released the following statements:

“People in Wisconsin believe in the protections guaranteed by the Affordable Care Act. That’s why I promised to stop spending Wisconsin taxpayer dollars on a lawsuit that would kick thousands of Wisconsinites off their healthcare and put the 2.4 million Wisconsinites who have a pre-existing condition at risk,” said Gov. Evers. “Today, I’m proud to say that promise has been fulfilled. It’s time for Republicans to stop blocking the will of the people and work with us to expand healthcare.”

“If the challenge to the constitutionality of the Affordable Care Act is successful, people with a pre-existing condition will lose critical protections, health-insurance coverage will be imperiled for millions of Americans, the health-insurance market will be destabilized, and our efforts to address the opioid epidemic will be undermined,” said Attorney General Kaul. “The State of Wisconsin will no longer be using tax dollars to support this lawsuit, which is contrary to interests of Wisconsinites.”

The United States Court for the Northern District of Texas Fort Worth Division previously granted Wisconsin’s motion to dismiss from the lower court’s case on April 2, 2019.
