Mr. Speaker, Repeal that Law!

Unconstitutional attack on women’s health should be stricken from state law

MADISON – Today, Rep. Chris Taylor (D-Madison) joined her Democratic colleagues in writing Assembly Speaker Robin Vos (R-Burlington) and Senate Majority Leader Scott Fitzgerald (R-Juneau) asking for their commitment to repeal provisions of 2013 Act 37 that both the 7th Circuit Court of Appeals in Schimel vs. Planned Parenthood of Wisconsin, et.al., and the U.S. Supreme Court in Whole Woman’s Health v. Hellerstedt have struck down as unconstitutionally thwarting women’s ability to access abortion.  Like one of the Texas laws struck down, Wisconsin’s unconstitutional law requires that physicians performing abortions have hospital admitting privileges within thirty miles.

“As the United States Supreme Court found in Hellerstedt and in rejecting Wisconsin Attorney General Brad Schimel’s personal, overtly partisan appeal to uphold this law, requiring hospital admitting privileges for only abortion providers has nothing to do with a woman’s health, but is a mechanism to make it harder for women to make and exercise intensely personal, private reproductive health care decisions,” stated Rep. Taylor.  “This hospital admitting privileges law should be immediately struck from Wisconsin statutes in light of these recent rulings and this legislature should focus on making it easier, not impossible, for women to access the healthcare they need.”

Assembly Republicans have frequently evoked outdated statutes and laws in justifying their unpopular policies – from civil service “reforms” to rewriting our campaign finance laws and opening the floodgates for more dark money in Wisconsin’s elections.

Earlier this session, Speaker Vos’s office put out a statement on Assembly Republican’s Red Tape Review initiative which looks to remove “nonessential and outdated rules.”

On February 17, 2015, he stated “[w]hile we achieved one of the largest updates of administrative code in Wisconsin history, there is still more we can do to ensure citizens are not being burdened by outdated and useless rules.”

“I look forward to working with Speaker Vos to repeal the unconstitutional provisions of 2013 Act 37 and work collaboratively to improve the lives of women across Wisconsin,” concluded Rep. Taylor.
