David Crowley Announces Plan to Protect Reproductive Freedom in Wisconsin’s Constitution

Crowley’s plan would put a constitutional amendment before Wisconsin voters that explicitly protects reproductive freedom

MILWAUKEE, Wis. – Today, David Crowley announced his proposal to protect reproductive rights and freedoms for women across Wisconsin.

As governor, David Crowley will work with the State Legislature to put a constitutional amendment before Wisconsin voters that explicitly protects reproductive freedom, including the right to abortion. Constitutional protection would provide a stronger safeguard against future efforts to take those rights away.

The 1849 criminal abortion ban is unenforceable after the state Supreme Court’s ruling, but other restrictions remain and future legislatures can change the law. Right now, women’s rights are only as safe as the next election, which is why David wants to enshrine them into Wisconsin’s constitution.

“As a husband and father, I believe that every Wisconsinite deserves the freedom to make personal decisions about pregnancy and reproductive health care. Meanwhile, three billionaires are spending $34 million to buy this election for MAGA Extremist Congressman Tom Tiffany who is an anti-abortion extremist and who backed a nationwide abortion ban at zero weeks with no exceptions for rape, incest or life of the mother. We can’t let him near the governor’s office,” Crowley said. “As governor, I will veto any ban, protect birth control, and fight to put your freedom in the state constitution where no politician, court, or billionaire can take it away. Bottom line: I will never stop fighting to defend a woman’s right to choose and make their own reproductive health care decisions.”

David’s proposal would:

  • Establish a fundamental right to make and carry out decisions about reproductive health, including contraception, fertility treatment, pregnancy, miscarriage care, and abortion.
  • Keep medical judgments about viability and necessary care with the treating health care professional.
  • Prevent the state from penalizing someone for seeking health care or helping another person seek care.

Legal protection must come with practical access. Crowley will also work to remove unnecessary barriers and improve access to affordable reproductive care throughout Wisconsin, including rural communities.

Amending Wisconsin’s Constitution requires approval by both legislative chambers in two successive legislative sessions, followed by voter approval. Crowley will advocate for passage and build public support for ratification.

Congressman Tom Tiffany celebrated the U.S. Supreme Court’s unprecedented decision to overturn Roe v. Wade and has said he would bring the same agenda to Wisconsin that’s so extreme that doctors are sounding the alarm.

By contrast, Crowley has been endorsed by Planned Parenthood Advocates of Wisconsin and Reproductive Freedom for All. And years before the Dobbs decision, Crowley supported the Assembly Joint Resolution 10 which declares abortion is healthcare.
